1. Introduction and Agreement

Welcome to XioraTravel. By booking a tour, accessing our website, or using our services, you (the “Client”) agree to be bound by these Terms and Conditions. These terms constitute a legal agreement between the Client and XioraTravel (hereinafter referred to as “the Agency,” “we,” “us,” or “our”).

Please read these terms carefully before making a booking. If you do not agree to these terms, you may not use our services.

2. Booking Contract

A booking is considered confirmed and a contract exists between the Agency and the Client when:

  • We have received the required payment (Full Payment for fixed tours or Deposit/Full Payment for custom tours); and
  • We have issued a written confirmation (Booking Voucher/Itinerary) to you via email.

Please verify all information on your confirmation email immediately upon receipt. We are not responsible for errors (e.g., incorrect names or dates) if not reported to us within 24 hours of confirmation.

3. Prices and Inclusions

What is Included:

As a luxury private tour operator, our prices generally include:

  • Private transportation (sedan, van, or Coaster) with a dedicated driver.
  • Professional bilingual tour guide services.
  • Entrance fees to scenic spots listed in the itinerary.
  • Accommodation (based on double occupancy) with daily breakfast.
  • Domestic travel insurance (Travel Agency Liability Insurance) as required by Chinese law.

What is Excluded:

  • International airfares or train tickets to/from China.
  • Chinese Visa fees.
  • Personal Travel Insurance (highly recommended).
  • Tips/Gratuities for guides and drivers (at your discretion).
  • Personal expenses (laundry, room service, alcohol, etc.).
  • Meals (Lunch and Dinner) unless specifically stated in the itinerary. We leave these flexible for you to explore local cuisine, though our guides are happy to recommend restaurants.

4. Travel Documents: Passports and Visas

It is the sole responsibility of the Client to ensure that they possess valid travel documents.

  • Passport: Must be valid for at least 6 months beyond your scheduled departure date from China.
  • Visa: Clients must obtain a valid Chinese Visa before travel (unless eligible for the 144-hour Visa-Free Transit policy).

XioraTravel is not responsible for any failure to obtain a visa or entry refusal by Chinese border authorities. If you are unable to travel due to visa issues, our standard Cancellation Policy applies.

5. Insurance

XioraTravel provides mandatory Travel Agency Liability Insurance, which covers accidents resulting from the agency’s negligence. However, this does not cover:

  • Trip cancellation due to your personal reasons or medical emergencies.
  • Loss of luggage or personal property.
  • Medical expenses for illness or injuries not caused by the agency.
  • Emergency medical evacuation.

Requirement: We strongly advise all clients to purchase comprehensive Travel Insurance from their home country prior to departure to cover these risks.

6. Health and Fitness

Clients should be in good health and able to participate in the planned activities. Some destinations (e.g., The Great Wall, Zhangjiajie, Tibetan areas in Yunnan/Sichuan) may involve significant walking, stairs, or high altitudes.

If you have any medical conditions, dietary restrictions, or mobility issues, you must inform us at the time of booking so we can make necessary arrangements. We reserve the right to decline a booking if we feel the itinerary is unsafe for a client’s health condition.

7. Liability and Disclaimers

XioraTravel acts as an intermediary between the Client and third-party suppliers (hotels, airlines, local transport providers). While we carefully select our partners to ensure high standards, XioraTravel assumes no liability for:

  • Loss, damage, accident, or delay caused by third-party suppliers.
  • Any injury, death, loss, or damage to personal property that is not due to the direct negligence of XioraTravel.
  • “Force Majeure” events (natural disasters, war, strikes, pandemics, government restrictions).

8. Behavior and Conduct

We reserve the right to terminate the tour for any client who:

  • Engages in illegal activities according to the laws of the People’s Republic of China.
  • Behaves in a manner that is abusive, threatening, or disrespectful to our staff, guides, drivers, or other travelers.

In such cases, the client will be removed from the tour immediately, and no refund will be issued for the unused portion of the trip. The client will be responsible for their own repatriation costs.

9. Complaints and Claims

If you are dissatisfied with any aspect of your tour, you must notify your tour guide or our 24/7 support team immediately while you are in China. We will make every effort to rectify the situation on the spot.

XioraTravel will not accept claims for refunds or compensation after the tour has ended if the client did not give us the opportunity to solve the problem during the trip.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the People’s Republic of China. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in the city where XioraTravel is registered.
